Therefore this 2-day Employment Act training in Malaysia gives you a clear, working grasp of what the law now requires and how to apply it in real workplace situations.

Who should attend this Employment Act training in Malaysia

Owners of SMEs, heads of department, line managers, executives, supervisors, team leaders and HR practitioners — in other words, anyone responsible for employment contracts, wages, leave, discipline or termination decisions. However, you need no legal background: the trainer teaches through case studies, practical calculations and workplace scenarios rather than legal theory.

  • Understand the current provisions of the Employment Act 1955 and the amendments in force since 1 January 2023
  • Distinguish a contract of service from a contract for service, and handle notice, breach and retirement correctly

  • Follow the correct investigation and procedure for sexual harassment complaints
  • Run retrenchment in line with the Code of Conduct for Industrial Harmony
  • Avoid the legal and procedural landmines that escalate into costly industrial disputes

Programme agenda

Day 1 — Contracts, Wages and Protected Categories

  • Introduction: scope of the Employment Act 1955 and amendments to the First Schedule; amendments to definitions and interpretations
  • Module 1 — Contracts of Service: contract of service vs contract for service; types of contracts; more favourable terms and conditions; right to join unions; notice of termination and calculating payment in lieu; handling breach of contract; retirement under the Minimum Retirement Age Act 2012
  • Module 2 — Wages: definition of wages and wage period; when wages must be paid and the consequences of non-compliance; amendments to payment of wages and restrictions; limitation on advances; lawful deductions; wages during imprisonment or court attendance; understanding and applying the Ordinary Rate of Pay (ORP)
  • Module 3 — Contractors, Principals and Contractors for Labour: amendments to information relating to supply of labour; amendments to restrictions and controls
  • Module 4 — Employment of Women & Maternity Protection: amendments to maternity leave; practical exercise calculating maternity leave entitlement and allowance; the maternity register; payment of maternity allowance
  • Module 5 — Domestic Servants: amendments to employment and termination of domestic servants
  • Practical session: hands-on application of the day’s provisions to real workplace scenarios

Day 2 — Working Time, Compliance and Penalties

  • Module 6 — Hours of Work, Rest Days & Holidays: rest day entitlement with practical calculation of rest day and overtime pay; amendments to limits on hours of work and shift work; limits on overtime; public holiday entitlement and ad-hoc holidays under the Holidays Act 1951; annual leave; amendments to sick leave, entitlement and offences, and managing false MCs; paternity leave
  • Module 7 — Employment of Foreign Workers: duty to submit returns; prohibitions under this Part
  • Module 8 — Flexible Work Arrangement: the FWA provisions and task-based projects
  • Module 9 — Sexual Harassment: interpretation and amendments to application; investigation and procedure; offences under this Part
  • Module 10 — Retrenchment, Termination & Lay-Off Benefits: provisions in the Code of Conduct for Industrial Harmony; entitlement to termination and lay-off benefit payments; how to compute them
  • Module 11 — Complaints and Inquiries: the Director General’s powers to inquire into complaints, and the limitations on those powers
  • Module 12 — Offences & Penalties: forced labour; general penalty; offence by body corporate; presumption as to who is employer and employee
  • Practical session: hands-on application and implementation planning
